These Terms and Conditions apply to all rentals and services provided by Cloud9 Parties, Inc. (“the Company”).

Booking Process and Basis of Hire

The client is kindly requested to initiate the booking process by contacting Cloud9 Parties Inc. in advance to discuss desired rental equipment and availability. This preliminary step is essential for the Company to confirm the availability of the desired equipment on the chosen dates. Upon receiving the inquiry, Cloud9 Parties Inc. will promptly provide information on equipment availability and confirm the applicable rental costs via a Booking Form.

To formalize the reservation, clients are required to submit the completed Booking Form to Cloud9 Parties Inc., accompanied by a 20% non-refundable deposit. Upon receipt of the Booking Form and deposit, the team at Cloud9 Parties Inc. will diligently review the submission. Clients will then be promptly informed of the acceptance status of their booking.

The client is responsible for providing accurate event and venue information and for all costs that may be associated, including but not limited to tolls and parking fees. The equipment is for personal use only, and the client affirms that they are acting as the principal party and not as an agent for another.

Rules of Use

It is imperative for the individual renting the soft play package to ensure strict adherence to all safety guidelines to prevent injury or damage. The following safety instructions must be followed:​

  • Shoes must be removed before using the soft play.

  • Socks must be worn at all times for hygiene reasons.

  • Parents supervising must also remove their shoes and wear socks.

  • Any damage may result in an additional fee.

  • Children must be supervised by a responsible adult at all times.

  • Cloud9 Parties Inc. does not provide supervision and assumes no liability for accidents or injuries.

  • No pets or sharp objects are permitted on the equipment.

  • Streamers, face paint, party poppers, or silly string are prohibited near the equipment.

  • No food, drinks, or chewing gum are allowed on or near the soft play.

  • Adults must not sit or lean on the equipment.

  • Children must not push, collide, fight, or engage in behavior likely to cause injury or distress.

  • No smoking or barbecues are allowed near the equipment.

  • The equipment must not be overcrowded and usage should be limited based on the age and size of the children.

  • The maximum age limit for use is 8 years old; adults are not permitted to use the equipment.

  • Individuals with a history of back or neck problems or children who are unwell should not use the equipment.

  • The equipment must not be used if wet, as surfaces may become slippery.

The client is responsible for ensuring the equipment remains undamaged. Repair charges for damages are payable immediately unless otherwise agreed. Only Cloud9 Parties Inc. staff are authorized to remove or collect equipment. No items may be removed from the delivery location. All balls must be gathered and returned to the ball pit prior to equipment collection. Equipment must be protected from weather elements such as direct sunlight and rain. For outdoor events, a covered area is required. A tent or canopy is strongly suggested.

Rental Period

The rental period incorporates the agreed-upon start and end times specified in the booking form. Equipment setup typically requires approximately 45–60 minutes and will begin immediately before the start time of the event. Pack-up and removal typically require approximately 30–45 minutes and will commence immediately at the end time of the event. Adherence to these timeframes ensures a smooth setup and a timely conclusion to the event.

Access

The client is responsible for ensuring clear and straightforward access to the venue for unloading and loading equipment. Any potential obstacles such as stairs, narrow doorways, or limited parking must be disclosed prior to the event.

Failure to provide accurate access information may result in delays, additional fees, or cancellation at the Company’s discretion.

 

The designated setup area must be clear of obstructions and debris. For outdoor bookings, the area must also be free of animal waste prior to arrival.

Payment Terms

A non-refundable deposit of 20% of the total rental cost is required at the time of booking to secure the reservation.

The remaining balance is due upon arrival at the scheduled event unless alternative arrangements have been agreed upon in advance. Failure to remit payment may result in cancellation without refund of the deposit.

Cancellation Policy

Cancellations made with a minimum of 14 days’ notice are eligible for a full refund of the deposit. Cancellations made within 14 days of the scheduled event are non-refundable. However, the deposit may be transferred to another booking, subject to availability and approval by Cloud9 Parties Inc.

Delivery Fees

Complimentary delivery is provided within a 10-mile radius of West Islip, NY. Locations beyond this radius may incur additional delivery fees, which will be discussed and agreed upon at the time of booking.

Soft Play Care

All equipment is delivered in a clean and sanitary condition. If significant dirt or staining is present upon collection, the client will be responsible for professional cleaning fees. Any damage, loss, or theft of equipment will result in additional charges. Equipment deemed beyond repair must be replaced at full market value within seven (7) days of the event.

Weather Cancellations

In cases of severe weather, including heavy snowfall or icy conditions, Cloud9 Parties Inc. reserves the right to cancel the booking in the interest of safety. In such cases, the deposit will be refunded in full.

Liability

The client assumes full responsibility for the proper use of the soft play equipment throughout the rental period and agrees to follow all safety guidelines.

 

Cloud9 Parties Inc. assumes no liability for accidents, injuries, or damages occurring during the rental period. The client acknowledges responsibility for supervision and maintaining a safe environment.

Operational Instructions

Operational instructions are crucial for ensuring the safe and enjoyable use of our soft play equipment. It is imperative to adhere strictly to the specified safety instructions, including the removal of shoes before utilizing the soft play. Parents supervising must also remove their shoes. Hygiene is paramount, requiring the mandatory wearing of socks at all times.

 

Adult supervision is essential to oversee the conduct of children and to ensure their safety during play. Prohibited activities such as the use of sharp objects, smoking, face paint, or the consumption of food and drinks near the soft play area must be strictly enforced.

Termination

Cloud9 Parties Inc. reserves the right to terminate services immediately in the event of unsafe behavior, misuse of equipment, or failure to follow safety guidelines.

Notification of Equipment Failure

Any concerns or issues related to equipment must be communicated immediately. The Company will assess and resolve issues when feasible to ensure continued enjoyment of the event.

Rescheduling

In the event that the Hirer needs to reschedule the soft play hire for any unforeseen circumstances, we kindly request timely notification to explore possible alternative dates. We understand that situations may arise, and we are committed to accommodating rescheduling requests to the best of our ability. While every effort will be made to accommodate the request, rescheduling is subject to availability.

Indemnification

The client agrees to indemnify and hold harmless Cloud9 Parties Inc., its affiliates, employees, and representatives from all claims, damages, or expenses arising from use of the equipment, including injuries or property damage.

Use of Photography & Video

We may occasionally take photos or videos of our setups for promotional purposes.
If you prefer not to have images from your event used, please let us know in writing before your event date. We always respect our clients’ privacy.

Force Majeure

In the event of circumstances beyond our control — such as severe weather, natural disasters, or emergencies — Cloud9 Parties may be excused from performance and will work with you to find a fair resolution, such as rescheduling or refunding your deposit.

Limitation of Liability

To the fullest extent permitted by law, Cloud9 Parties’ total liability for any claim, damage, or loss related to your event will not exceed the total rental amount paid.
We are not responsible for indirect or consequential damages, such as lost profits or event interruptions.

Breach

In the event of a material breach by either party, the non-breaching party may pursue remedies available under applicable law following written notice and opportunity to cure.

Governing Law and Jurisdiction

These terms are governed by the laws of the State of New York. Any disputes will be handled in Suffolk County, NY.

Minors & Parent/Guardian Responsibility

Use of the soft play equipment by individuals under the age of 18 is permitted only under the supervision of a parent or legal guardian. By allowing a minor to participate, the parent or legal guardian acknowledges and agrees to these Terms and Conditions and accepts full responsibility for the supervision, conduct, and safety of the minor(s) during the rental period.

A parent or legal guardian must be present and is solely responsible for ensuring that all safety guidelines and usage instructions are followed. Cloud9 Parties Inc. assumes no responsibility for supervision and accepts no liability for injuries, accidents, or damages involving minors.

 

Cloud9 Parties Inc. reserves the right to refuse service or discontinue use of the equipment if proper supervision is not maintained.
